Terms of service

1. Agreement

These terms govern your use of Merto.ai and the services we provide. By subscribing or using the service, you agree to them. If you do not agree, do not use the service.

2. Service

We provide AI communication services for businesses, including car dealerships: an assistant that answers and sends calls, texts, and emails, books appointments, captures leads, follows up, and keeps a shared memory of every customer conversation so inquiries land with you. For some clients we also host and maintain a business website (hosting, SSL, and domain registration in your business name) as part of that system, never as the product by itself. The exact services, fees, and scope that apply to you are set out in your order or agreement with us, confirmed before you subscribe.

3. What you provide

Accurate business information (services, hours, licensing, and contact details). Permission to use the facts and copy we prepare and you approve. Timely answers when we need clarification to run coverage or ship an edit.

4. Domain and your content

Where we register a domain for you, it is registered in your name. If you cancel, the domain stays with you and we help transfer it or update DNS as needed. Text, photos, and other content you supply remain yours. We export it on request after cancellation, as described in our privacy policy.

5. Billing and cancellation

Setup and monthly fees are charged as quoted at signup. You may cancel at any time; service continues through the billing period you have paid for, then it stops and any site we host for you is taken offline. Setup fees are non-refundable unless we agree otherwise in writing.

6. Limit of liability

We work carefully and review copy before it goes live. To the fullest extent permitted by law, our total liability for any claim relating to the service is limited to the subscription fees you paid us in the twelve months before the claim. We are not liable for indirect or consequential damages. A different limit requires a separate signed agreement.

7. Text messaging (SMS)

We may send text messages related to your inquiry or account, for example a reply when we miss your call, a response to a form you submit, or a follow-up in that conversation. Consent is collected when you call or text us first, or submit a form that includes SMS consent language. Message frequency varies. Message and data rates may apply. Reply STOP to cancel at any time or HELP for help, or contact hi@merto.ai. Carriers are not liable for delayed or undelivered messages. How we handle SMS data is described in our privacy policy.

8. Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario.
